Under the Wildlife and Countryside Act 1981, it is an offence to intentionally damage or destroy an active bird's nest. The main nesting season runs from 1 March to 31 August, and our best practice is to avoid cutting during this period. That said, cutting is not automatically illegal during nesting season — the offence requires intent. If we check first and find no active nests, work can go ahead legally at any time of year. The safest window is September to February, and for most hedges a cut in early autumn and again in late winter gives the best results. We always inspect for nesting activity before we start.
